Legal draft

Terms of Use

These Germany-oriented draft terms are a structured starting point for the ArcticExile website and future games.

Important: These terms are provisional and contain choices that only the legal operator can make. Replace all highlighted placeholders and obtain appropriate legal review before treating them as final.

1. Operator and agreement

These Terms of Use (“Terms”) are between you and [INSERT LEGAL OPERATOR OR COMPANY NAME], located at [INSERT BUSINESS ADDRESS AND COUNTRY], operating as ArcticExile (“ArcticExile,” “we,” “us,” or “our”). The complete provider details must be supplied in the Legal Notice.

By accessing this website or, when released, using an ArcticExile game or related service, you agree to these Terms and the applicable privacy policy. If you do not agree, do not use the service.

2. Eligibility

You must be legally capable of accepting these Terms. The minimum age and parental-consent approach must be confirmed for each game and region: [INSERT MINIMUM AGE AND PARENTAL CONSENT RULES].

3. Current website

The website currently provides studio information, project updates, support details, and contact channels. TinyMerge is described as being in closed testing on Google Play; this does not promise public availability. Other game titles, features, availability, and release timing are not promised unless expressly confirmed in an official announcement.

4. Game licences

Before TinyMerge or another game launches publicly, insert the intended licence terms, account requirements, device limits, permitted use, virtual items, purchases, subscriptions, advertisements, and update policy: [INSERT GAME LICENCE AND COMMERCIAL TERMS].

Any Google Play distribution will also be subject to applicable Google Play terms and policies. Where those platform terms apply to a purchase or download, they operate alongside these Terms.

5. Acceptable use

You may not misuse the website, a closed-test build, or a future game. Prohibited conduct includes attempting unauthorized access, interfering with security or availability, distributing malicious code, scraping in a way that harms the service, impersonating others, infringing rights, cheating or manipulating gameplay where relevant, or using the service for unlawful activity.

6. Intellectual property

The ArcticExile name, selected logo, website design, original artwork, text, software, and future game content are owned by or licensed to the legal operator, subject to applicable law. No ownership is transferred to you. Confirm trademark ownership and any third-party licences before finalizing: [CONFIRM IP OWNER AND REGISTERED RIGHTS, IF ANY].

7. Feedback and submissions

If you send feedback, bug reports, or suggestions, you permit us to use them to evaluate and improve the service without an obligation to adopt or compensate for them, except where law requires otherwise. Do not submit material you do not have the right to share.

8. Third-party services and links

The website and games, including closed-test builds, may rely on or link to third-party services such as Google Play, Cloudflare, and email providers. Those services have their own terms and privacy practices. We do not control third-party services, and their availability is not guaranteed.

9. Support, purchases, and refunds

Support is available at support@arcticexile.com. Future purchase and refund terms must match the game, applicable law, and Google Play requirements: [INSERT PURCHASE, BILLING, CANCELLATION, AND REFUND TERMS].

10. Updates, suspension, and termination

We may need to update, suspend, or discontinue parts of a service for maintenance, security, legal, technical, or business reasons. Before a game launches, confirm the notice, account, saved-data, and termination approach: [INSERT GAME-SPECIFIC SUSPENSION AND TERMINATION TERMS].

11. Availability and statutory rights

We do not promise uninterrupted availability or that all website content will always be complete or error-free. Maintenance, security incidents, and circumstances outside reasonable control may interrupt access. Mandatory statutory rights, including consumer warranty and remedy rights, remain unaffected.

12. Liability

Liability is governed by mandatory German law. Nothing in these Terms limits liability where German law prohibits limitation, including liability for intent or gross negligence, injury to life, body, or health, and liability under mandatory statutory rules. Any further limitation for ordinary negligence or indirect loss must be drafted and reviewed for the actual service: [INSERT A GERMAN-LAW-COMPLIANT LIABILITY CLAUSE OR LEAVE THIS SECTION LIMITED TO THE MANDATORY RULES ABOVE].

13. Consumer dispute resolution

The operator must publish whether it is willing or obliged to participate in dispute resolution before a consumer conciliation body and, if so, identify the competent body, as required by § 36 German Consumer Dispute Resolution Act (VSBG): [CONFIRM PARTICIPATION STATUS AND, IF APPLICABLE, THE CONCILIATION BODY].

The former EU Online Dispute Resolution platform was discontinued on 20 July 2025 and is therefore not linked here.

14. Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Germany. For consumers, this choice does not remove mandatory protections granted by the law that would otherwise apply, including the law of the consumer’s habitual residence. Statutory rules determine the competent courts. Any additional venue clause for merchants requires legal review: [INSERT A REVIEWED MERCHANT VENUE CLAUSE OR “NOT APPLICABLE”].

15. Changes to these Terms

We may update these Terms when the service, law, or business changes. The updated effective date will be displayed above. Confirm how material changes will be notified before a game launches: [INSERT NOTICE METHOD].

16. General provisions

If part of these Terms is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A delay in enforcing a provision is not necessarily a waiver. Mandatory statutory rules take priority over any conflicting wording in these Terms.
